GUEST RENTAL AGREEMENT

LICENSE TO OCCUPY

These Terms and Conditions of Booking are a contract between 3SIXTY5 Stays and you the person making the Booking and all adult members of your party who will be staying in any of our apartments.

By making a Booking or staying in our Accommodation you agree to abide by these terms and conditions:

1.1 Your booking is with 3SIXTY5 Properties, a Limited Company registered in England and Wales under registration number 14914128. Our head office is located at 20 Wenlock Road, London N1 7GU.

1.2 References to “you” or “your” refer to the person or organisation making the booking with 3SIXTY5 Stays.

1.3 These terms apply to all bookings made through the 3SIXTY5 Stays website (https://3sixty5.co.uk/), by email (info@3sixty5.co.uk), by telephone, or in person with 3SIXTY5 Stays. Bookings made via Booking.com, Airbnb, VRBO & any other online booking platform will also be subject to these terms.

1.4 Your booking is confirmed, and a legal contract is concluded once your payment has been successfully made. No booking is made or contract concluded when payment is declined or unauthorised.

1.5 You agree that the booking is for a short-term stay for leisure, business, or temporary purposes and does not give rise to an assured shorthold tenancy or lease. It is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977. You will not be entitled to any rights under any statutory provision including, without prejudice to the foregoing generality, the Rent Act 1977, any assured tenancy or assured shorthold tenancy under the Housing Act 1988, or any tenancy arising under or in terms of, or regulated by the Housing (Scotland) Act 1988, Housing (Scotland) Act 2006, Housing (Scotland) Act 2014, Private Housing (Tenancies) (Scotland) Act 2016, including in each case any amendment or re-enactment of any such statute for the time being in force.

1.6 Bookings can be for any length from one night up to three months. Bookings longer than three months must be agreed with the company director. Bookings may be made at any time up to 2pm on the first night of your stay.

1.7 Bookings may only be made by a person aged 18 or above, and there must be at least one person aged 18 or above staying in the accommodation.

1.8 You may not resell or re-assign your booking to any other person or organisation except with the express authority of 3SIXTY5 Stays.

2. Payment and Cancellations

2.1 All payments shall be made by Credit, Debit Card, or bank transfer. 3SIXTY5 Stays charges 2% for credit or debit card fees made for direct bookings. 3SIXTY5 Stays cannot accept cash for any payments.

2.1.1 Payment by credit/debit card is the preferred option for online bookings placed directly on https://3sixty5.co.uk/.

2.1.2 Bank Transfer (BACS) is the preferred payment option for bookings placed over the phone.

2.2 Full payment is required upon booking unless expressly agreed otherwise by 3SIXTY5 Stays or if payment is taken through other means such as through online travel agents.

2.3 The total price for your entire stay will be presented to you before you confirm your booking and make payment. Our pricing is dynamic, and therefore the price for the same or similar accommodation may vary over time after your booking is made. This does not confer upon 3SIXTY5 Stays any right to require additional payment where the price increases and does not confer any right on you to a discount if the price decreases.

2.4. When booking directly with 3SIXTY5 Stays, via phone, email or through the direct booking website. The cancellation policy is as follows:

   2.4.1.If the booking is less than 5 days long, you can cancel 5 days before check in to receive a full refund.

   2.4.2. If the booking is between 5 and 14 days long, you can cancel 7 days before check in to receive a full refund.

   2.4.3. If the booking is for 14 days or more, you can cancel 14 days before check in to receive a full refund.

   2.4.4. If you cancel within 24hrs of making the booking with us, you will receive a full refund, with the exception of bookings that are made within 14 days of the scheduled check-in date.

   2.4.5. With all cancellations, a small refund processing fee may be charged.

   2.4.6. If you have made the booking through an online travel agent such as Airbnb, Booking.com or VRBO, the cancellation policy is as stated on your booking confirmation.)

2.5 Both 3SIXTY5 Stays and you may cancel the booking at any time up to 28 days prior to the first day of your booking with 3SIXTY5 Stays, in which case a full refund will be made to you.

2.6 3SIXTY5 Stays reserves the right to cancel bookings within 5 days of the first day of the reservation where necessary due to reasons outside of 3SIXTY5 Stays reasonable control or in the event of an overbooking due to delays or errors within the booking system. In the event of such cancellation, the client will receive a full refund.

2.7 No refunds will be made for non-arrivals or if you decide to check out early.

3. Your Stay

3.1 Check-in time is from 3pm, and check-out time is no later than 10am, unless expressly agreed by 3SIXTY5 Stays otherwise. Additional charges may apply for early check-in or late check-out. Information on the check-in and check-out procedure and access to the accommodation will be provided separately.

3.2 3SIXTY5 Stays provides serviced accommodation rather than a hotel or guest house service.

3.3 Included in your room/apartment will be one set of linen and towels. A cleaning service is provided, and further information is available on request.

3.4 You are responsible for the conduct of all persons staying within the accommodation and shall ensure that they comply with these terms and conditions

3.5 Any Booking obtained under false pretence will be subject to forfeiture of advance payment, deposit and/or booking money and the party will not be permitted to check in.

3.6 You agree to leave the accommodation in a reasonable state on departure, including rubbish being placed in rubbish bins, and soiled dishes being washed and dried. If, at our discretion, additional cleaning is required on departure beyond the standard level, the cost of this cleaning will be charged.

4. Damage, Theft, and Costs

4.1 3SIXTY5 Stays reserves the right to charge to the credit/debit card used for payment or any other card used to provide security in respect of:

   4.1.1 The cost of replacing or repairing any property of 3SIXTY5 Stays including furniture, upholstery, fittings, appliances or other fixtures and items which are damaged during your stay;

   4.1.2 The cost of replacing any items of property which are stolen from the accommodation during your stay

   4.1.3 Any breach of our non-smoking policy. A minimum charge of £1000 will be charged to your card where we find evidence of smoking within the accommodation to cover cleaning costs but we reserve the right to charge additional amounts to cover any damage caused by smoking.

   4.1.4 Consumption, storage, sale or misuse of any illegal substances or associated paraphernalia. A minimum charge of £1000 will be charged to your card where we find evidence and/or we suspect that there has been the sale or use of illegal substances within the accommodation to cover responsible removal and additional cleaning costs, but we reserve the right to charge additional amounts should there be a reasonable requirement to do so.

4.2 Such costs may be charged on check-out, or 3SIXTY5 Stays reserves the right to apply such charges to your card at a later date where necessary.

4.3 Where 3SIXTY5 Stays is unable for any reason to apply such a charge against your credit/debit card then an invoice will be sent to you and which you agree to pay within 14 days of receipt.

4.4 3SIXTY5 Stays will provide a receipt including a break-down of costs for all additional charges made to your credit or debit card.

4.5. Loss of 3SIXTY5 Stays property and other additional charges that could be incurred during your stay at the property are listed below:

● Lost keys – £150.00

● Lost apartment fob – £150.00

● Lost car park fob – £150.00

Lost parking permit – £150.00

● False Emergency Call out charge (outside working hours) – £150.00

● Excessive cleaning – £50.00 per hour

Disruption / Noise complaints / Disruptive Social Gatherings – £100.00

 Inappropriate items flushed down toilet – £150.00

Unauthorised early check-in (before 3pm) – £50/hr

● Unauthorised late check-out (after 10am) – £20/hr

● Damaged items and/or decor/furniture/fittings – case by case basis to cover repair/replacement

Extra Linen – £50.00

4.6 Guests will be given the option to either:

  1. Pay a refundable damage deposit of £250, which will be collected via an online payment link prior to check-in. This deposit will be returned within 7 days of check-out following an inspection of the accommodation, provided it is returned in accordance with the terms of this Agreement. Deductions, if any, will be made in accordance with clauses 4.1 – 4.5 above;

OR

  1. Pay a non-refundable damage waiver fee of £50. This waiver reduces the guest’s liability for accidental damage to a maximum of £50. Any damage exceeding this amount will be charged to the guest’s credit or debit card accordingly. The waiver does not cover damage caused by negligence, misconduct, breach of house rules, theft, or deliberate actions.

4.7 Guests will ensure they take photos upon check-in of any existing damage if they are concerned that it may affect their damage deposit and should email them on the day of check-in to info@3sixty5.co.uk. Unless we receive notification otherwise within 12 hours of check-in, any new damage ( for example holes or dents in walls/ marks on fabric throughout the Accommodation/damage to electrical goods/fixtures/fittings/flooring/surfaces etc.) discovered post check-out will be charged against the security deposit.

4.8 Guests will ensure they take photos upon check-in of any cleanliness issues. Unless we receive notification otherwise within 12 hours of check-in, we will be entitled to assume that you have fully accepted that the condition of the Accommodation is in good condition and in a clean and tidy state and you will waive any right to claim otherwise.

4.9 Risk of damage to the Accommodation and its contents will pass to you on check-in and remain with you until the Accommodation is returned to us. You shall be liable for all loss or damage (except fair wear and tear) caused during the Booking, and for any reasonable loss of rental resulting from such loss or damage.

4.10 If you fail to pay any Additional Charge within 14 days of the date of our invoice requiring payment of the same, you will incur an administration fee of £50 to cover the costs of sending you our debt collection letter, which will follow.

4.11 Extra cleaning policy: To ensure we maintain the property’s high standards and maximise guest experience, we require weekly cleaning and linen changeovers for long-term bookings (14+ nights stay). 3SIXTY5 stays reserves the right to charge the Guest for this extra cleaning.

5. Privacy, Data Protection, Credit/Debit Card Security & Security Cameras/Audio Recording Devices

5.1 3SIXTY5 Stays processes information about you that you provide when making a reservation and/or upon check-in in accordance with our privacy policy. By providing this information, you consent to such processing.

5.2 We are required by law to maintain a register of all guests’ names and nationality and to keep such details on file for at least 12 months from the date of arrival.

5.3 We use a secure third-party service to process card payments (www.stripe.com/gb). This service is PCI-DSS compliant and allows us to make charges to your credit and debit card in accordance with these terms.

5.4 We use Security cameras/audio recording devices on all our premises. The cameras are located at the front (and in some cases at the rear) of the property and only record the entrances to monitor guests coming in and out of the property. In accordance with the Data Protection Act (1998), all guests are made aware of any Security cameras/audio recording devices at the time of booking where information of the Security cameras/audio recording devices is disclosed on the listing page. These devices can be used as evidence of a breach of this agreement.

5.5 We use privacy-safe noise monitoring devices inside our premises to monitor how loud guests are being to avoid disturbance of neighbours and to make sure guests are complying with these terms and conditions. The Noise monitoring devices do not record sounds and instead only monitor the level of noise. These devices also monitor humidity, temperature, motion and can detect the smoking of cigarettes. These devices can be used as evidence of a breach of this agreement.

6. Complaints

6.1 3SIXTY5 Stays wants to ensure you have an enjoyable stay. If you have a problem during your stay, please inform any member of staff who will be able to assist you.

6.2 If 3SIXTY5 Stays is unable to informally resolve any complaint you have at the time of your stay, you may submit a formal complaint using the contact details provided.

6.3 Complaints regarding issues with the accommodation upon arrival must be emailed to info@3sixty5.co.uk on the day of check-in, and we will use all reasonable efforts to resolve the matter as quickly as possible.

6.4 3SIXTY5 Stays reserves the right to reject without further investigation any vexatious complaint or complaint made in bad faith.

7. Limitation of Liability

7.1 The liability of 3SIXTY5 Stays to you under these terms and conditions shall be limited to the total value of your booking (unless the Hotel Proprietor’s Act 1956 applies, in which case our liability will be limited to the maximum prescribed under that Act).

7.2 3SIXTY5 Stays shall not be liable in any circumstances to you for any consequential or indirect loss including loss of profit, data, management time, reputation or goodwill.

7.3 3SIXTY5 Stays shall not be liable for any damages or loss caused by conditions or events beyond its reasonable control (force majeure) including, but not limited to:

   7.3.1 Strike, lockout or other labour dispute affecting the employees of 3SIXTY5 Stays ;

   7.3.2 Acts of God;

   7.3.3 Natural disasters;

   7.3.4 Acts of war or terrorism;

   7.3.5 Act or omission of government, highway authorities or telecommunications carrier, operator or administrator;

   7.3.6 Delay in manufacture, production or supply by third parties of equipment or services required for the performance of the Services or production and supply of the Goods;

7.4 All descriptions and photographs of the Accommodation are for illustration only and we do not warrant that they are accurate or complete, although we do use all reasonable endeavours to ensure that they are.

7.5 Save where there is a total failure to provide useful Accommodation as reasonably expected under this agreement, we cannot be held responsible for any failure or interruption to services to the Accommodation, for example, gas, water and electricity, or for any damage, disturbance or noise caused as a result of maintenance work being carried out in any part of the building.

8. Severability

8.1 If any provision of these terms and conditions is held to be invalid, illegal, unenforceable, or in conflict with the law, the remaining provisions shall not be affected.

9. Waiver

9.1 The failure of any party at any time to require performance of any provision or to resort to any remedy provided under these terms and conditions shall in no way affect the right of that party to require performance or to resort to a remedy at any time thereafter, nor shall the waiver by any party of a breach be deemed to be a waiver of any subsequent breach. A waiver shall not be effective unless it is in writing and signed by the party against whom the waiver is being enforced.

10. Entire Agreement

10.1 These terms and conditions constitute the entire agreement of the parties and supersede all prior communications, understandings, and agreements.

11. Guest Obligations

11.1 The Guest has the right to occupy the property for the period defined on their booking confirmation. The Guest is responsible for the conduct of all persons staying within the accommodation during this period and shall ensure that they comply with these terms and conditions. The Guest agrees:

   11.1.1 To indemnify 3SIXTY5 Stays and will keep us indemnified on demand for all claims, liabilities, losses, costs and expenses (including legal fees) incurred or suffered by us (except any incurred as a result of our default) in connection with this Agreement or in connection with any use or misuse of the Accommodation, except for personal injury or death caused by our act or omission.

   11.1.2 In no circumstances should overnight accommodation be provided for guests other than those declared to 3SIXTY5 Stays. Not to permit any visitors to stay at the property without prior written consent from a representative of 3SIXTY5 Stays.

   11.1.3 To undertake to pay for any losses or damage to the property caused.

   11.1.4 To take good care of the property and leave it in a clean and tidy condition at the end of the stay.

   11.1.5 To permit the Owners and 3SIXTY5 Stays reasonable access to the property.

   11.1.6 Not to cause an annoyance or become a nuisance to occupants of adjoining or nearby premises.

   11.1.7 Not to be the cause of any noise between 10:00 pm and 8:00 am.

   11.1.8 Not to smoke in the property or any of the public areas associated with it. All rooms and common spaces in our accommodation are strictly non-smoking – you and other guests may only smoke outside of the premises.

   11.1.9 Not to bring any animals, insects, birds or reptiles into the property unless expressly agreed by 3SIXTY5 Stays.

   11.1.10 To read any safety notices and advice upon arrival at the property.

   11.1.11 Not to re-let or sublet the property to any other group/party.

   11.1.12 To only use the property strictly for residential purposes.

   11.1.13 Not to use the property for parties or gatherings. If it is felt the Guest is intending to use the property for such an event, the Guest will be refused entrance.

   11.1.14 Not to make use of the phone or fax line connected to the property.

   11.1.15 Not to light any fires or candles in the property.

   11.1.16 Not to run a business from the property.

   11.1.17 Not to throw a party or event. If this is not respected, the Guest will be charged £2000.

   11.1.18 Not to hang or place wet or damp articles of washing upon any room heater.

   11.1.19 Not to make the property their permanent residence.

   11.1.20 Not to use more linen than supplied to the guest unless confirmed with 3SIXTY5 Stays.

   11.1.21 Not to engage in any illegal activity on the premises.

   11.1.22 Keep the accommodation free of hazardous objects at all time and not to leave it in a condition that would make it unsafe for housekeepers, staff, fellow guests or themselves to use.

   11.1.23 Not install any portable cooking appliances and will ensure all personal electronic devices are safe to use.

   11.1.24 Indemnify 3SIXTY5 Stays and will keep 3SIXTY5 Stays indemnified on demand for all claims, liabilities, losses, costs and expenses (including legal fees) incurred or suffered by us (except any incurred as a result of our default) in connection with this Agreement or in connection with any use or misuse of the Accommodation, except for personal injury or death caused by our act or omission.

   11.1.25 Not behave in an abusive, threatening or discriminatory manner toward our staff, neighbours and fellow guests.

   11.1.26 Not change any lock on the accommodation or have any duplicate keys made.

   11.1.27 To take all reasonable precautions to prevent condensation by keeping the property adequately ventilated and heated. Extractor fans located in the bathrooms and en-suites must be switched on at all times to prevent damage to the Accommodation.

   11.1.28 Not to leave the entrance door or windows to the property open but ensure that all door and window locks are properly engaged at all times. All windows must be closed when not in the Accommodation or during bad weather. Theft and damage caused as a result of the Guest not leaving the Accommodation secured will result in the Guest being charged for the damage and stolen items.

   11.1.29 To clear the accommodation of all personal belongings, open the check out time and agree that 3SIXTY5 Stays and their service partners have no responsibility to return any belongings after the guest has checked out. It is the Guest’s sole responsibility to ensure they have completely checked the accommodation. If items are left, 3SIXTY5 Stays has the right to discard these at their discretion.

   11.1.30 Not to tamper with, unplug, cover  or de-activate any fire alarms, emergency equipment, security cameras, or any other security/safety devices.

   11.1.31 Not to remove, damage or destroy any 3SIXTY5 Stays property;

   11.1.32 Not to use any technology provided by 3SIXTY5 Stays to download or access any unlawful or obscene material;

   11.1.33 Not to cause unreasonable disturbance to our other guests or any 3SIXTY5 Stays staff;

   11.1.34 Not to fail to return your room/property keys/fobs/cards at the end of your stay as, in the interests of security, we may have to replace the corresponding locks.

   11.1.35 Not to  remove or use any extra linen from the locked linen cupboard. Please contact 3SIXTY5 Stays guest services if you need extra.

   11.1.36 Not to charge an electric car using the main power supply.

   11.1.37 To accept full responsibility for their own vehicles and their contents and agrees that vehicles are parked at their own risk. 3SIXTY5 Stays is not responsible for any parking fines in any circumstances.

   11.1.38 To provide all suitable childproofing safety equipment when small children are in the property.

   11.1.39 To notify 3SIXTY5 Stays as soon as is practicably possible of (a) any plumbing, electrical or general problem or (b) any damage to the property or its contents and shall desist from attempting to remedy such problem on their own.

11.2 In the event of a breach of this agreement, the Guest will be required to leave the property immediately, and no refunds will be offered.

11.3 The Guest is obliged to provide the full names of any individuals staying at the property and may be required to present valid photo ID for each individual. If any individuals other than those declared on the booking occupy the property, a charge of £200 per extra guest per night.

11.4 The Guest is responsible for ensuring that the property is not occupied by more people than stated on the Guest’s booking confirmation email. 3SIXTY5 Stays reserves the right to refuse admittance to the property if it feels this condition is likely to be breached. In this case, no paid funds will be returned.

11.5 In the event of an emergency, the guest is asked to:

● Make use of the fire blanket and/or fire extinguisher if appropriate.

Leave all belongings and exit swiftly through the main exit, ensuring all individuals requiring assistance are brought to safety.

Wait on the main road away from the building and inform emergency services by calling 999 and quoting your location.

11.6 By signing this agreement, you acknowledge that you are not protected from the eviction act 1977.

12. Third Party Rights

12.1 Nothing in this Agreement is intended to, nor shall, confer any rights on a third party unless expressly provided otherwise.

13. Jurisdiction

13.1 This Agreement shall be construed in accordance with English Law, and the Courts of England and Wales shall have exclusive jurisdiction in so far as any matter arising from this Agreement is required to be referred to a court of law.
